Tony Awards begin with Judith Light win

NEW YORK (AP) ? Judith Light, who plays an acerbic alcoholic in "Other Desert Cities," won won the first acting Tony Award of 2012 on a night that promises to be a nail-biter in many categories and a feast for the eyes and ears with a record 16 musical numbers.

The former "Who's the Boss?" and "Ugly Betty" star wins for for best featured actress in a play. She was also nominated last year for her performance as Vince Lombardi long-suffering wife in "Lombardi."

With no clear, dying-to-see-it front-running musical like last year's juggernaut, "The Book of Mormon," the show Sunday at the Beacon Theatre actually began with a nod to the past, with host Neil Patrick Harris joining with the cast of "Mormon" for their opening number of "Hello!" from the 2011 musical winner.

He then was surrounded by dancers in tuxes and shimmering dresses for a rousing original number in which he wished that real life was more like theater, complete with backup dancers, rhymes and quick costume changes. He had cameo help from Patti LuPone, the little red-headed orphan from "Annie" and a flying Mary Poppins.

"Once" won two awards before the show began, with Martin Lowe taking the honor for orchestration, and Enda Walsh taking home the award for best book of a musical.

Christopher Gattelli, who thrillingly combined ballet with bold athletic moves in "Newsies, won the best choreography Tony. His work included a sequence of synchronized dancing on real newspapers and carving out of a few moments for each young dancer to spotlight their talents. It is his first award; he previously was nominated for "South Pacific" in 2008.

The three-hour telecast is packed with stars and performances from musicals, plays and revivals. The explosion of performances is an attempt to showcase as much on Broadway as possible. One performance won't even be nearby ? the song from "Hairspray" will be performed from a cruise ship in the Caribbean Sea.

It promises to be a hectic night. During a rehearsal, winners were warned that they only had 90 seconds from the time their name was called to get on stage and give their speech before loud music will drown them out.

Last year's Tonys was seen by 6.9 million viewers, roughly the same number as the year before. But the program posted a 9 percent year-to-year gain in the ratings for the 18-to-49 demographic.

The popular Harris is back again this year with several songs and skits. He'll be competing Sunday against the "Mad Men" season finale, but this time no NBA postseason games.

He'll also been tasked with trying to MC between performances from the four best musical nominees ? "Leap of Faith," ''Newsies," ''Nice Work If You Can Get It" and "Once." To make time, most technical awards will be handed out during the commercial breaks.

The four musical revival nominees also get a turn on stage, with performances from "Evita," ''Follies," ''The Gershwins' Porgy and Bess" and "Jesus Christ Superstar." There will even be time carved out for the cast of "Godspell" and "Ghost: The Musical" ? two shows not up for best musical Tony.

As if that wasn't enough, look out for performances from the Tony-nominated plays "End of the Rainbow," ''One Man, Two Guvnors" and "Peter and the Starcatcher." There also are video snippets from other plays.

Producers of the telecast are counting on some intriguing matchups to keep interest high: Which play will win from a very strong category? Will James Corden from "One Man, Two Guvnors" take the best drama leading man award from the favorite, Philip Seymour Hoffman in "Death of a Salesman"? Who will emerge with the award in the best actress in a drama race ? Nina Arianda, Tracie Bennett, Stockard Channing, Linda Lavin or Cynthia Nixon?

Harris will have plenty of help on stage, from both veterans of Broadway and newcomers. The list of presenters includes Jessica Chastain, Nick Jonas, Tyler Perry, Amanda Seyfried, Jim Parsons, Paul Rudd, Ellen Barkin, Angela Lansbury, Bernadette Peters, Candice Bergen, Christopher Plummer, James Marsden, Mandy Patinkin and Sheryl Crow. Hugh Jackman will get a few moments to talk after being presented with a special Tony.

The Tony Awards show is serious business and the exposure in front of millions is priceless. Many shows that are suffering pre-summer slumps are counting on a bump from the telecast. "Godspell" producer Ken Davenport was warned that his production's future may hinge on making a splash at the ceremony.

Overall, the health of Broadway is good, with shows yielding a record $1.14 billion in grosses this season, and total attendance reaching 12.3 million. The only concern is that audience numbers were flat, meaning higher ticket prices are pushing the overall box office take.

This season, 40 new shows opened ? 14 new musicals, 23 new plays and three specials. Many of the musicals once again relied on Hollywood, with "Once," ''Ghost The Musical," ''On a Clear Day You Can See Forever," ''Newsies" and "Leap of Faith" all originating on celluloid.

Some older works ? "Follies" and "Death of a Salesman" ? reminded a new audience why they are classics. And George and Ira Gershwin ? or at least their estates ? are clear winners, with the revival of "Porgy and Bess" and the musical "Nice Work If You Can Get It" proving Gershwin songs still soar.

But, if anything, this was the season of brilliant original plays: "Clybourne Park" by Bruce Norris, "Other Desert Cities" by Jon Robin Baitz, "Peter and the Starcatcher" by Rick Elice and David Ives' "Venus in Fur."

So loaded with talent was this category that plays such as David Henry Hwang's "Chinglish," Katori Hall's "The Mountaintop," Nicky Silver's "The Lyons," David Auburn's "The Columnist" and Theresa Rebeck's "Seminar" didn't even get nominations.

James, Heat find their way back to NBA finals

MIAMI (AP) -- Several weeks before this season even started, LeBron James and Kevin Durant were competing against each other.

Hell Week, they called it, a four-day series of grueling workouts.

Starting Tuesday, they'll meet again. They'll call that the NBA finals.

Neither was playing at the level they are now when James invited Durant to work out with him during the NBA lockout in his hometown of Akron, Ohio. Now as James tries to win his first ring, fittingly, it's Durant in his way.

"It's only right. It's only right," James said. "We look forward to the challenge. It's going to be a big test for us."

James played at a rarely seen level in the Eastern Conference finals against the Boston Celtics. According to STATS LLC, James became the first player since Shaquille O'Neal in the 2000 finals to have six 30-point games in a playoff series. In the one contest where James didn't score 30, he finished with 29 in Game 4, fouling out in overtime.

His series averages against the Celtics: 33.6 points and 11 rebounds per game on 53 percent shooting. He had five games with at least 30 points and 10 rebounds in the entire regular season - then did it five times in the series against Boston alone.

"He was absolutely brilliant this series, and we all know it," Heat coach Erik Spoelstra said. "He's playing at an historic level during the playoffs, driving us with his will. We do not take his talent or his will or his competitiveness for granted. And we need every single bit of it. He is pushing himself beyond his limits, and he's pushing the rest of the team as well."

Said Heat guard Dwyane Wade: "He's amazing."

There were many moments for the Heat to celebrate on Saturday night, when they punched their ticket back to the NBA finals by ousting Boston 101-88 in Game 7.

Heat owner Micky Arison couldn't have gotten his hands off the East trophy fast enough, since that isn't the one he wants anyway. James felt the same way. The Heat star left the floor in a cap and T-shirt, one arm raised in joy.

Behind him, the celebration continued. By then, he was already thinking about what's next.

"I really thought he in particular played a very smart, aggressive game," Celtics coach Doc Rivers said. "He kind of let the game come to him, and then down the stretch he took the game over. That's what great players do."

They don't do it alone, though.

Criticized last season for deferring too often in crucial situations, James went into the offseason driven by the pain of failing in the NBA finals. And even during the lockout, he did anything he could to improve - two-a-day workouts, studying with Hakeem Olajuwon, yoga, boxing, beach sprints, even asking Durant to come to Akron for a few days for some training.

In those sessions, they pushed each other to the limit.

"Me and KD, man, just tryin' to get better," James said in a video of one workout posted online.

And look at them now, two superstars set to fight for one ring.

"I envisioned it every day we worked out," James said. "I understood what his passion was. I understood what his drive was."

They both understood the other perfectly.

James and the Heat lost to Dallas in last season's finals. Durant and the Thunder lost to Dallas in last season's Western Conference finals. This probably couldn't have been scripted any better. Maybe the two best players in the world, scarred by similar disappointment, trying to make the other better.

And when the final series of the season begins Tuesday night in Oklahoma City, they'll each have a close-up view of how far the other has come.

"It's going to be a battle," Durant said.

The Heat and Thunder split two games during the regular season, both winning at home. Durant scored the most points in the NBA this season at 1,850, James was second with 1,683. James won the MVP award, Durant finished second in that balloting. And in these finals, one will finish first again, the other will finish second again.

"It's not about Kevin and LeBron," Thunder coach Scott Brooks said. "It's not about any other thing other than playing good basketball against a very good team. ... Individually, they're the best players in the league.

"They have many ways that they score and many ways that they help their team win. They make winning basketball plays, they're both defensively very good, they both get rebounds, they both pass. But it's always about the Thunder against the Heat."

There's probably little argument that James and Durant have been the premier players in this postseason. James is averaging 30.8 points, 9.6 rebounds and 5.1 assists, while Durant is at 27.8 points, 7.9 rebounds and 4.2 assists. But while Durant is celebrated for what he's doing as a 23-year-old on the rise in a small market, James gets the constant reminder of how he's a 27-year-old without a championship despite moving to Miami.

"LeBron James, I just have a feeling a lot of people are just waiting to pin failure on him versus objectively evaluating his game," ESPN analyst Jeff Van Gundy said during the East finals. "I mean, think about it. ... James has an every-night pressure that no one else has. I don't understand what people don't like about him."

It seems no matter what James does or how well he plays, some can't get past The Decision - that infamous televised special where he announced he was signing with Miami in 2010. If he passes, he should have shot. If he shoots, he is being selfish. If he puts up 45 points and 15 rebounds, like in Game 6 of the East finals, some ask why he doesn't do that every night. If the Heat win, the reminders come that they didn't win it all last season.

Those around James say the scrutiny drives him.

James, for his part, says he does his best to ignore it all.

"I can't worry about what people say about me, about my game, about who I am as a person,", James said. "I can't get involved in that. People can have their own opinions, and rightfully so. They can have their own opinions. For me I just go out and play at a high level, and do whatever it takes for us to win. And I can be happy with that."

Gas drops nearly 16 cents in the last three weeks

NEW YORK -- The average price for a gallon of regular gasoline in the United States fell 15.9 cents to $3.624 in the past three weeks due to a drop in crude oil, which took a hit from fears over Europe's economy and a stronger dollar, the Lundberg Survey showed.

The national average for regular gasoline as of June 8 was down more than 11.62 cents from the year-earlier level of $3.74 a gallon, according to the survey of some 2,500 gasoline stations in the continental United States.

The price was the lowest since the Feb. 10 survey, which recorded an average of $3.51 per gallon.

It was the fourth straight survey to show a price decline. Prices peaked at $3.967 on April 6 and have been falling ever since, down 34.28 cents, survey editor Trilby Lundberg said.

The average price of a gallon of diesel has fallen by nearly the same amount, down 30.61 cents over the past nine weeks and 17.64 cents over the past three, to $3.9089.

Both gasoline and diesel prices are lower than a year ago.

"U.S. fuel consumers have had a significant benefit as both diesel and gasoline prices crashed. Crude oil is the cause of both," Lundberg said.

The average price of a gallon of gasoline at self-serve stations was the lowest in Jackson, Mississippi at $3.18. Seattle had the highest at $4.22, partly because of a fire at BP's Cherry Point refinery in Washington state.

Different companies, products and services have different trademarks but they are all aimed at creating a distinct symbol that will identify that particular product or company. The use of trademarks has legal implications and it is protected by the common law as well as Federal laws.

A trademark owner is entitled to the exclusive use of the trademark in the product specifically intended to be identified by the trademark or to other related product which he owns.

The trademark user and owner can register his trademark with the Patent Office. Any trademark can be registered for as long as it is not own by anyone and that the entity seeking its registration is already using or is planning to use the trademark in the future. However, unregistered trademarks are still protected under the common law as long as the owner can establish his use of the trademark.

A trademark can be a word or combination of words or symbols that differentiates a certain products from the others. Trademarks are different from patents and copyrights in the sense that a copyright is geared towards the protection of original works of art including music or literary works while a patent is geared towards the protection of an invention.

Why should individuals or companies register their trademarks if these are already protected by law even if they are unregistered? Registration of trademarks is encouraged because the fact of registration serves as legal and practical notice to the public that it is already being used and owned by another. The owner can also sue another entity in Federal Court, for using a registered trademark. Such registration can also be used as a basis for registering the same trademark in other countries.

Anyone can already use the trademarks sign ?TM: or the service mark ?SM? even if the marks have not yet been registered.

However, the Federal symbol of registration can only be used after the mark has been registered with the United States Patent and Trademark Office.

Registration of trademarks or service marks can be done through the internet. After submitting the form online, the registrant can expect an immediate reply or issuance of an initial receipt from the Trademark Office. Applications can also be delivered to the Trademark Office.

The registration process is actually easy and self explanatory that there is no need to hire a lawyer. You must however comply with all the requirements for registration for a quick processing of your application.

What Apple didn't announce Monday

Monday was a big day for Apple: a brand new MacBook Pro design, iOS 6, and some new information on Mountain Lion. But there were a few things conspicuously absent, as well; let's go over what items and features we didn't see on stage at the Worldwide Developers Conference in San Francisco.

  • 15-inch MacBook Air: The next-generation MacBook Pro may be thinner and lighter than its predecessors, but it's still no MacBook Air. It weighs two full pounds more than the smaller Air, and of course it doesn't have that tapered shape. Some thought a bigger Air was forthcoming, but Apple clearly wants to keep overlap between the MacBook lines to a minimum.

  • 13-inch Retina?MacBook Pro: Again, perhaps not announced in order to keep the lines distinct, but it may also be because the displays aren't ready. A 13-inch version would probably have a 2,560-by-1,600 display (that is, twice the existing 13-inch resolution in both directions).
  • 17-inch MacBook Pro: Fans of Apple's biggest notebook must have observed already that there don't seem to be any plans to bring it back in Retina form. With a focus on portability and battery life, there just isn't any room in the lineup for this beast any more. And if you go to Apple's online store, you'll find that it's been removed from the lineup.
  • Retina display on the Air: There were rumors that Apple was going to bring those tiny pixels to their tiny notebook. But it wasn't a realistic hope to begin with. First, they would have to raise the price of the Air; those screens aren't cheap. And since the Air is now Apple's?bargain computer, they can't be raising the price up again. Second, the new MacBook Pro is meant to be understood as a professional, expensive computer. The Retina screen helps differentiate it from the Air and gives it an air of luxury and helps justify the price.
  • Retina Cinema Display or iMac: High-resolution displays are obviously in the cards for Apple's more stationary products ??with the OS and apps being built around them, it's only a matter of time. But either Apple wanted to focus on just notebooks for now, or the companies that actually make the displays need more time to perfect and manufacture the larger versions.
  • Funky new keyboard: Patents for a totally new kind of keyboard that would allow for thinner laptops ? or just more space on the inside for batteries and components. It didn't appear, however: the new Pro has the familiar chiclet keyboard that Apple notebooks have had since 2006.
  • Liquidmetal anything: Apple's purchase of the company that makes this versatile alloy set alarm bells ringing in the tech community. So far, the only thing they've used the material for is the SIM card tray in the iPhone. Even its makers say that anything larger is still a long ways off, but that didn't stop people from expecting a whole notebook made out of the stuff.
  • Hybrid storage: There were reports of a custom hard drive system, a cross between solid-state and spinning drives, to give the responsiveness of the one and the capacity of the other. But this is looking less and less likely for a number of reasons. It would be expensive to implement and repair, the drive would suck power and take up space, and both flash memory and cloud storage are getting cheaper and faster by the day. If it was ever being researched in the first place, it's probably scrapped by now.
  • New Mac Pro: Apple did in fact update the Mac Pros to take advantage of the latest RAM and processors, but with no stage time and no real redesign, it's clear they're low on the priority list right now ? or perhaps the big update is coming whenever the iMac and other desk-type computers get theirs.
  • iPhone 5: Obviously the new version of Apple's hit phone (likely to be called simply?"the new iPhone") was not announced, though a few hopeful souls were thinking it would be a great surprise to bring out or at least tease alongside iOS 6. No such luck; it'll be?a few more months for sure before they'll take your money for that particular item.

  • Smaller iPad: Persistent whispers from the supply line and overseas manufacturing community suggest the existence of a smaller iPad with a 7.85-inch screen. WWDC would have been as good a place as any to announce it, but clearly the iPad mini is not ready for prime time ? that is, if it exists at all.
  • iTV: After a hurricane?of leaks, rumors, and speculation earlier in the year, everyone was ready for the Apple-branded television to touch down at WWDC. But aside from an improvement to AirPlay streaming over existing Apple TVs, there was nary a mention of the project Steve Jobs reportedly spent a great deal of time working on toward?the end of his life.
  • Apps for Apple TV: On that note, it was expected that the Apple TV would be getting apps, or its own special app store, or something to bring it into Apple's lucrative app ecosystem. No go ??at least, not yet.

Some of these things may arrive later this year, some next year, some never. But one thing we can be sure about is that they didn't get announced at Monday's keynote.
