Pentagon review recommends combat pay changes

WASHINGTON (AP) ? A Pentagon review recommends ridding the combat pay system of inequities that have allowed officers thousands of miles from battle to get better benefits proportionally than troops on the front lines in Afghanistan.

The recommendations in a review released Thursday are likely to anger service members. But the director of the review said they're aimed at paying more to troops who are in the gravest danger and giving the best tax benefits to those who are paid the least.

Military officers who are not near the fight can sometimes get more in combat pay and tax benefits than troops who are getting shot at on the front lines, said Thomas Bush, who directed the review. He said the main goal was to make combat pay more equitable.

The report doesn't recommend any specific rates of combat pay or say that certain troops should get less. But, Bush said, "we suggest there be some meaningful distinction" between troops who are getting shot at and those who are simply deployed to one of many countries designated as combat zones.

The recommendations are very preliminary, and Pentagon spokeswoman Eileen Lainez said Friday that they will merely provide alternatives to the Defense Department to consider. Such changes often must be approved by Congress.

Under the military's current system, there are two types of combat pay. One, called "hostile fire pay," gives troops $225 a month if they are in an area where they could be exposed to enemy fire.

The second, called "imminent danger pay," gives up to $225 per month to those who are in a combat zone, and it is pro-rated at $7.50 a day, based on how long they are there.

Bush said the report recommends that hostile fire pay be more than the danger pay and that there be levels of imminent danger pay based on where service members are. Currently they can get the danger pay for being in more than two dozen places, including Bahrain, Saudi Arabia, Kyrgyzstan, the Philippines and Jordan ? as well as in Afghanistan, Yemen and Somalia.

"We want to target compensation to people who are at the greatest risk," Bush said.

In December 2009, President Barack Obama directed the department to examine four specific areas: combat pay, benefits and pay for the National Guard and Reserve, compensation for wounded service members and their survivors and pay incentives for key defense jobs, such as drone operators, special operations forces, linguists and mental health professionals.

Under the current system, service members up to the top level senior enlisted rank do not pay taxes on their pay when they are in a war zone. Higher level officers would not pay taxes on the portion of their salary equal to the top senior enlisted members' amount.

When they go to a combat zone, the taxes are no longer taken out of their pay, giving them an automatic raise for their deployment time.

The proposed change would make the combat pay a refundable tax credit that service members would file for at the end of the tax year.

But Bush said that because of the federal tax code, the benefits for higher level officers clearly outweigh the tax benefits for low-ranking troops, because much of their pay would already be at a very low tax rate.

The panel was struck by that disparity, Bush said, adding that a senior officer could get as much as a $15,000 tax benefit, while an Army private might get a $1,000 tax benefit.

And yet the private serving at a combat outpost in Kandahar or Khost in Afghanistan has a much higher chance of getting killed or injured than a senior officer serving in a headquarters unit or in Bahrain.

Congress members have been loath to do anything that appears to cut combat pay and have often tried to increase pay raises for the military. Bush acknowledged that it's not clear how open they would be to the changes recommended by the report, but he said he hoped lawmakers would be open to making the system more equal.

Sorkin nervous ahead of 'Newsroom' premiere

Despite a long list of small screen and big screen successes, including the Emmy-winning series "The West Wing" and the Academy Award-winning film "The Social Network," screenwriter Aaron Sorkin still worries before a big premiere.

When TODAY's Savannah Guthrie sat down with the man behind HBO's upcoming cable-news-themed series, "Newsroom," and asked him if he felt any trepidation ahead of its Sunday night debut, he left little doubt of his pre-premiere jitters.

"Oh, God -- you can't even imagine," Sorkin said.

It's not that the 51-year-old man known for crafting rapid-fire dialogue and scenes with a real feel has any particular reason to be concerned. It's just his routine. Still, the writer's nerves are easily disguised by his enthusiasm for the project.

Veteran actor Jeff Daniels heads "Newroom's" ensemble cast as Will McAvoy, and early clips reveal his character to be a passionate and familiar-feeling anchor. But Sorkin warns that he shouldn't seem too familiar. Though rumors to the contrary abound, McAvoy isn't based on cable newsman Keith Olbermann -- or any other particular anchor.

"I want to emphasize that it's a fictional character," he insisted. "I've spent time in a lot of newsrooms and so the show's got one foot in reality and one foot in this kind of romantic wish fulfillment and fantasy."

(AP) ? Federal prosecutors Friday will begin presenting their case against a Saudi man accused of gathering bomb components in his West Texas apartment with the goal of targeting sites across the United States.

Khalid Ali-M Aldawsari, 22, faces up to life in prison and a $250,000 fine if convicted of attempted use of a weapon of mass destruction. Targets he allegedly researched included the Dallas home of former President George W. Bush, dams and nuclear plants.

Opening statements are set for Friday morning. Aldawsari, a former Texas Tech University chemical engineering student who has pleaded not guilty, will then watch as prosecutors begin to present as many as 34 witnesses and 429 exhibits to try to prove their case to a jury in federal court in Amarillo, where the trial was moved for reasons not made public.

A jury of eight women and six men was selected Thursday; the panel includes two alternates.

Court records show Aldawsari's attorneys plan to use an insanity defense.

Federal agents secretly searched Aldawsari's apartment in Lubbock, Texas, twice in February 2011 and say they found almost everything needed to build a bomb, including chemicals, beakers, flasks, wiring, a hazmat suit and clocks, which he had bought online in the previous months.

Authorities say they were tipped to Aldawsari's online purchases by chemical company Carolina Biological Supply of Burlington, N.C., and shipping company Con-way Freight on Feb. 1, 2011. The chemical company reported a $435 suspicious purchase to the FBI, while the shipping company notified Lubbock police and the FBI because it appeared the order wasn't intended for commercial use.

Court records show that Aldawsari had successfully ordered 30 liters of nitric acid and three gallons of concentrated sulfuric acid in December 2010.

Aldawsari also kept a handwritten journal, in Arabic, in which he said he had been planning a terror attack in the U.S. for years, even before he came to the country on a scholarship, and that it was "time for jihad," or holy war, according to court documents. He bemoaned the plight of Muslims and said he was influenced by Osama bin Laden's speeches.

U.S. District Judge Donald E. Walter ruled last week that prosecutors can use footage from videos found on Aldawsari's computer, including one in which Ayman al-Zawahri, al-Qaida's current leader, praises as martyrs two unspecified individuals killed by "American Crusaders." Two instructional videos that he also allowed show how to prepare the explosive picric acid and how to use a cellphone as a remote detonator.

TNP, the chemical explosive Aldawsari was suspected of trying to make, has about the same destructive power as TNT. FBI bomb experts said the amounts in the Aldawsari case would have yielded almost 15 pounds of explosive ? about the same amount used per bomb in the London subway attacks that killed scores of people in July 2005.

Aldawsari came to the U.S. in October 2008 from Riyadh, Saudi Arabia, to study chemical engineering at Texas Tech. He transferred in early 2011 to nearby South Plains College, where he was studying business. A Saudi industrial company, which was not identified in court documents, was paying his tuition and living expenses.

During jury selection Thursday, Aldawsari's attorney, Dan Cogdell, asked potential panelists if they would have any issue with Aldawsari's Muslim faith or Saudi citizenship. Cogdell also asked if they would "think kind of hard about" sitting next to a Saudi citizen on an airplane.

Aldawsari sat next to his attorneys wearing a dark blue suit jacket and silver tie, and sporting hair that was shorter than during his previous court appearances.

The issue here is there are great questions about both men. Franklin is fighting for the first time in 16 months after a major shoulder injury, but I think he has more left and finds a way to stop Silva in a fun fight.

Maggie Hendricks: Rich Franklin W3 Wanderlei Silva -- Though it's not the fight we were hoping for, it's still going to be fun to watch two legends face off. They'll both get bloody and bruised, but Franklin will come out the winner.

Cagereader: Franklin's tough chin, technical striking and solid footwork will lead him to out point Silva and win a decision ... again.? -- Daniel Christian

Google to pay $0 in damages to Oracle, wait for appeal

After watching Judge Alsup strike down its patent and Java API infringement claims, Oracle seems to be cutting its losses, agreeing to accept $0 in damages from Google. Confused? So was the Judge, who reportedly responded to the proposal by asking, "is there a catch I need to be aware of?" No catch, but Oracle isn't giving up, stating that it's taking its case to the Court of Appeals for the Federal Circuit. If successful, the appeal could put the two firms back in Alsup's courtroom, perhaps asking for somewhere between the previously proposed $32.3 million and today's sum total of zilch. We'll let you know when the drama comes around again.
