12 companies join Stanford and Berkeley to launch new Open Networking Research Center

A consortium of twelve of the world's foremost networking companies today became founding sponsors of the Open Networking Research Center (ONRC), a collaborative research effort to explore software-defined networking (SDN) as the new networking paradigm and provide open-source networking tools and platforms. The founding sponsors include: CableLabs, Cisco, Ericsson, Google, Hewlett-Packard, Huawei, Intel, Juniper, NEC, NTT Docomo, Texas Instruments and VMware.

The faculty directors of the ONRC are Nick McKeown (Stanford) and Scott Shenker (Berkeley), who are both professors of electrical engineering and computer science at their respective institutions.

"SDN is a complete reimagining of networking," said McKeown. "We're lifting it out of the proprietary, black-box paradigm that has dominated networking for decades and looking at a future characterized by open interfaces and open-source software."

Shenker adds that "For two decades, networking has remained essentially stagnant and networks are far too expensive, complex, and difficult to manage. This is about to change thanks to SDN, which will enable network engineers to innovate freely and make networks simpler and less expensive while becoming vastly more capable."

SDN arose out of the graduate work of Martn Casado at Stanford, in collaboration with McKeown and Shenker. SDN has been rapidly adopted by industry, with standardization efforts underway and hardware already on the market, but there is a critical need for the fundamental science necessary to exploit SDN's full potential. Martn Casado, now CTO at a startup building SDN solutions, said: "While industry is making great progress in commercializing SDN, we are still in the very early stages of SDN and we need to secure SDN's intellectual foundations if this is to truly revolutionize networking."

The Open Networking Research Center is charged with developing a comprehensive intellectual framework for this new era of networking. ONRC includes three components: The networking research groups located at Stanford University and UC Berkeley headed by McKeown and Shenker, respectively; and an independent, non-profit Open Networking Laboratory led by Guru Parulkar (who will serve as executive director of the ONRC and is currently consulting professor of electrical engineering at Stanford) that will develop an open-source SDN infrastructure.

"The Open Networking Research Center is a big bet on the future of software-defined networking, said Parulkar. "The research center will become the factory of ideas that turns the concept of open-source networking into the reality of practical tools and applications that will soon transform networking."

Question Of Whether It's Legal To Use Trademarks As Keywords ...

The U.S. Court of Appeals for the Fourth Circuit?today revived part of Rosetta Stone?s trademark lawsuit against Google, meaning the search giant?s permitting the use of trademarked terms in AdWords is still legally questionable in the United States. It?s the first time an appellate court has ruled in a case of this kind.

Previously, a federal court in the Eastern District of Virginia issued a summary judgment in the case in 2010, essentially saying that the language software maker didn?t have a valid trademark infringement claim against Google. Rosetta Stone appealed.

The company had accused Google of trademark infringement, contributory and vicarious trademark infringement, trademark dilution and unjust enrichment ? all related to Google allowing advertisers to use Rosetta Stone?s trademarks as either keywords or ad text in its AdWords program.

Though the appeals court affirmed the lower court?s decision with respect to the vicarious infringement and unjust enrichment claims, the judges said the direct infringement, contributory infringement and dilution claims need to be sent back to the Virginia court for further action.

In the direct infringement matter, the appellate court believes the lower court didn?t properly or fully consider some of the evidence, especially where a likelihood of confusion is concerned. Additionally, though the district court applied the ?functionality doctrine? in the case, saying that Rosetta Stones trademarks became a part of the function of Google?s technology, the appeals court said the functionality doctrine doesn?t apply.

On the subject of contributory infringement, at issue is whether Google knew or should have known that people using its service were infringing on Rosetta Stone?s trademarks. The court of appeals said this question deserves a closer look, rather than a summary judgment.

Additionally, the court of appeals found that the lower court hadn?t properly applied the legal precedents with regard to trademark dilution, so that matter needs to be reconsidered.

AT&T has gotten a good amount of attention lately for unlocking off-contract iPhone handsets, but a recent report from MacRumors suggests that the carrier is extending the same privilege to members of the US military currently serving overseas. While we haven't been able to verify the report, we'd like to believe that news of AT&T's goodwill gesture is indeed genuine. Naturally, we're rather curious to know whether this policy extends to AT&T's entire range of handsets. No one gets hurt sitting on their couch?. ? Health and Fitness ...

Last week I had the chance to catch up with a friend I hadn?t spoken to in ages. She was telling me all about how? busy she was preparing for the holiday, taking care of kids and juggling work ?.all having to manage it on her own because her husband had to have surgery from an injury he sustained while performing an aggressive military style work out.

?

My husband used to say ?No one ever gets hurt sitting on the couch? (until a crane on the upper east side crashed into a high rise apartment and killed a guy siting on a couch proved him wrong)?.but his point was that when you do Risky activities you are more likely to get HURT.

Another friend of mine participated in one of those obstacle races recently where you have to climb over 15 foot walls, crawl through dirt and jump over tires?.all for ?FUN? (?.if you asked me i don?t understand what is fun about mud in your mouth ?)?..She too was injured from that race.

It made me think about the time in my life when i became certified as a fitness instructor and attended a 3 day fitness conference ?.it seemed that everyone was trying to outdo the other and the attendees were seeking the ?newest? thing in the ?FIT? world.

Instructors would get up on stage and demonstrate the latest moves they had ?invented? such as leaping over 3 BOSU balls in a row while holding 20 pound dumbbells in each arm and landing on their head to balance on their? finger nails.

It made the episode of ?Happy Days? ? when Fonzi had to jump the shark ? seem safer.

Each session was over the top with instructors trying to outshine the other?until one of them actually fell and broke her foot while performing the exercise she claimed ?anyone can do?.

I went home thinking that Jane Fonda had it right?.Leg lifts and sit ups. BASICS.Back to Basics.

As you know, I am a firm believer in push ups and squats? for a complete full body routine.

Looking back at the agenda of that conference and talking to my injured friends i had to think that the old acronym ?KISS? is possibly the best advice when it comes to a workout regimen?..

KEEP IT SIMPLE STUPID

The ?Basics? really WORK!

Skip the fancy kettle bell cleans that pop a shoulder out of its circuit and just stick to the basic swings.

There is no shame in doing a basic simple movement that works the muscle ? NO DIFFERENTLY- than a ?fancier? made up ?creative? move that ultimately leads to injury.

When you complicate matters you end up hurting something or ? someone else!

Lesson Learned: leave the creativity to the art world and stick with the simple (not easy) moves that have been around since the cavemen.

PUSH your body and PULL your body and you will see that it?s really ALL you need to stay FIT.

(AP) ? Unions are facing a make-or-break moment in their campaign to drive Wisconsin's Republican governor from office.

If unions and their Democratic allies prevail in the recall ? just over a year after Gov. Scott Walker signed legislation to curb collective bargaining rights for most public workers ? it would send a powerful warning to other politicians who might try to limit union rights. Unions also might find it easier to turn out more voters in November for President Barack Obama in this battleground state.

A Walker victory would be a stunning setback for organized labor.

"If we lose, it's a shot in the mouth," said Greg Junemann, president of the Professional and Technical Engineers union and a Milwaukee resident. "We can survive it, but we'll be reeling."

Unions have experienced mixed results over the past year in trying to beat back efforts in dozens of states to restrict bargaining rights, pass right-to-work laws or limit how unions collect dues.

They enjoyed a major victory in November when Ohio voters in a statewide referendum repealed a law limiting collective bargaining rights for the state's public employees. But they fell short in an earlier recall campaign to wrest control of the Wisconsin Senate from Republicans and suffered a major defeat when Indiana this year became the first state in more than a decade to pass right-to-work legislation.

Recalling a sitting governor would be a major feat, something that's happened only twice before in U.S. history.

"After devoting so much effort, energy and funds to the recall, unions have to show positive results or it will be judged to be a sign of a weakened labor movement," said Gary Chaison, professor of industrial relations at Clark University in Worcester, Mass. "If they can't win in one of the most liberal states, where can they win?"

The recall primary in Wisconsin is May 8, and the general election is June 5.

Such massive, costly campaigns have taken a toll on unions, diverting resources they could have spent helping political allies or organizing new members. Unions spent nearly $30 million turning out votes to repeal the Ohio measure and more than $12 million on the Wisconsin state Senate recall effort.

"Unions are not bottomless wells when it comes to resources for this stuff," said former AFL-CIO political director Steve Rosenthal. "As we're forced to wage these fights to defend what we've got, it's a win-win for the other side because they force us to spend a lot of money to plug holes in the dike."

Unions and others had little trouble gathering more than 900,000 signatures to authorize a recall election for Wisconsin's governor. Finding a suitably pro-union candidate to take on Walker has not so easy. Most unions have lined up behind former Dane County Executive Kathleen Falk, who has pledged to veto any state budget that doesn't reinstate collective bargaining rights.

But unions now face a new hurdle in Milwaukee Mayor Tom Barrett, who announced last month that he, too, would run in the Democratic primary, even after union leaders tried to talk him out of it. Barrett, who narrowly lost to Walker in 2010, has stronger statewide name recognition than Falk, but he has clashed with unions in the past and refused to take the unions' veto pledge.

Barrett's entry into the race means unions will have to spend even more money to boost Falk's profile. It also puts them in a bind. They are reluctant to publicly attack Barrett for fear of damaging him in the event he wins the primary. Because their ultimate goal remains ousting Walker, they face the prospect of having to spend even more resources in the general election to support a Democrat they don't really trust.

Falk has won the endorsement of the statewide teachers union and the largest union representing public workers. No unions have backed Barrett so far, but the head of the Wisconsin Professional Police Association has praised Barrett and there could be a rift if some unions rally behind the Milwaukee mayor.

Wisconsin's largest public employees union got into trouble last week by directing its members to an Internet video that attacks Barrett and incorrectly implies that Barrett supported Walker's plan to curb bargaining rights. The Wisconsin chapter of the American Federation of State, County and Municipal Employees said it used poor judgment and acknowledged the video was "over the top."

Rich Abelson, executive director of Wisconsin's AFSCME District Council 48, suggested unions wanted to avoid negative attacks on Barrett. "Labor and AFSCME's main priority is to defeat Scott Walker," Abelson said.

Walker, meanwhile, is casting the recall as a battle with out-of-state "union bosses" who want to benefit from taxpayer money.

"This is about sending a message about don't mess with us or we'll take you out no matter who you are," Walker said in an interview with The Associated Press. "For all the talk about collective bargaining, for the national unions it's really about the money."

Walker has already raised more than $12.1 million for the race ? the majority of it from out-of-state donors ? breaking a previous fundraising record that Walker himself set in the 2010 governor's race. Unions plan to spend at least as much as they spent on the state Senate recall campaign.

Walker's proposal, which passed the Republican-controlled Legislature despite massive protests and all 14 Senate Democrats fleeing to Illinois for three weeks, targeted only public workers and exempted most fire and police officers.

It forced state and local government employees, including teachers, to pay more for health insurance and pension benefits, and stripped away collective bargaining rights except over salary increases no greater than inflation. It also did away with automatic dues withdrawals and forced annual votes for the unions to stay officially recognized.
